Gucci vs. Guess

The fashion world has become witness to a lawsuit situation once again. Gucci and Guess went head to head to the court in New York. The luxury legend Gucci has sued Guess for using Gucci’s signature ”G” sign and mimicking the label’s trademark logos including the usage of green and red stripes.

Guess CEO Paul Marciano went to the court the previous day to defend his label after being accused of copying Gucci designs as well as logos. On behalf of Guess, he refused the accusations and pointed out that designing a bag with the same components and with the same capital G was just inspiration which whole fashion world is about.

On the other hand, Gucci lawyer presented some strong evidences to the court. The lawyer highlighted the e-mails between Guess and the company that makes the label’s shoes. The mails are about exchanging swatches of Gucci fabrics so as to mimic the logo colors extremely accurate.

Guess is still defending itself by emphasizing that the inspiration is everywhere;  however Gucci seems to take the label’s longtime revenge in many ways.

 

 

Moda dünyası yeni bir telif hakkı davasına daha şahit olmuş bulunmakta. Gucci ve Guess arasında uzunca bir süredir süren gerilim sonunda mahkemeye taşındı ve Gucci rekor bir ücretle Guess’ e tazminat davası açtı. Gucci’ nin G’ sini ve kırmızı- yeşil çizgilerden oluşan logosu ile kristal temasının işlendiği tek logonun birebir kopyalandığını iddia eden marka yetkilileri, maddi manevi ciddi bir zararın marka kişiliğine olumsuz etkide bulunduğunu belirtti.

Davalı Guess’ in CEO’ su Paul Marciano ise durumun sadece bir esinlenmeden ibaret olduğunu, aynı ürünler ve aynı baş harfle üretim yapan iki markanın bu tür benzerliklerle karşılaşılmasının son derece yaygın bir hadise olduğunu belirtti. Gucci avukatlarının ileriye sürdüğü delil ise suları daha da hızlandırdı.

Guess ve markanın ayakkabılarını yapan üretim atölyesi arasında geçen elektronik postalarda, Gucci’ nin numunelerinin değiştirildiği ve renk kartelasının birebir uygulanabilmesi için işlemlerin sürdürüldüğüne dair yapılan yazışmalar delil olarak mahkemeye sunuldu.

Sonuç ne getirecek, Guess rekor tazminati ödeyecek mi bilinmez, ancak iki markanın da mevcut durumdan reklam ve halkla ilişkiler anlamında ziyadesiyle fayda! gördüğü aşikar.
